Welcome to Exclusive Use.  We are delighted you are here.  These Terms explain how our website works and what you can expect when you browse our collection or send an enquiry.  By using the website, you agree to these terms.

Exclusive Use helps planners discover distinctive properties for retreats, meetings, incentives & personal stays  We showcase a curated collection and connect you with the people who own and manage each property.

Exclusive Use is operated by Tourism Portfolio Group Pty Ltd (ACN 656 627 904), trading as Exclusive Use.  In these Terms, ‘we’, “us” and “our” means Exclusive Use, and “you” means anyone who visits or uses our website.

These Terms apply to use of the Exclusive Use website, including our property pages and enquiry forms.  Separate terms apply to our property partners, the Loyalty Program and any booking you make with a property owner.

2. How our Website Works

Our website is a place to explore properties and begin a conversation direct with the properties.  We provide the website to help facilitate introductions between website users and property owners.

Each property is independently owner and operated.

  • Exclusive Use does not own, operate or manage the properties featured on the website;
  • We are not the accommodation provider or event supplier;
  • We do not take deposits or booking payments on behalf of a property; and
  • You must not attempt to interfere with the operation of the site or misuse its content.

3. Property Information

We take care in presenting our collection and aim to keep property information up to date.  However descriptions, images, capacities, inclusions and conditions may be supplied by property owners and can change.

Our curation reflects the qualities we look for in an Exclusive Use property, but it is not an ongoing guarantee or certification of a property’s condition, suitability, safety, accessibility, availability or legal compliance.

Before confirming a booking, please check anything important to you directly with the property owner.  This may include availability, final pricing, taxes, deposits, inclusions, guest or event capacity, accessibility, cancellation terms, insurance requirements, property-specific rules and other things.

4. Enquiries and Bookings

Sending an enquiry is simply the first step in the conversation.  It does not reserve a property or create a booking.

A booking is confirmed only when you and the property owner have completed the steps required under the property owner’s booking terms.  This may include signing an agreement and paying a deposit.

The property owner’s terms will cover the practical details of your booking, including pricing, payments, deposits, changes, cancellations, refunds, inclusions and property rules.  Please read those terms carefully before confirming your booking.

5. Cancellations, refunds & changes

Exclusive Use does not process refunds for bookings directly received to the property.  Bookings are made directly with the property owner, and the property owner’s terms apply to cancellations, postponements, changes, credits & refunds.  We recommend reviewing the property’s cancellation policy before confirming your booking

If a booking changes or is cancelled, please contact the property.

6. If something is not right

We recommend reviewing the property’s cancellation policy before confirming your booking.  Exclusive Use is not liable for any costs or losses incurred due to cancellations or changes made by the property owner.

In the event of a dispute about a booking, we encourage you to contact the property owner first.  We may assist with communications where appropriate.

If the matter cannot be resolved informally, disputes will be handled in accordance with the laws of New South Wales, Australia.

7. Using our website thoughtfully

We ask everyone to use the website respectfully, lawfully and for genuine personal or business purposes connected with the properties and services we feature.

Please do not:

  • Submit false, misleading, fraudulent or speculative enquiries;
  • Pretend to be someone else or claim to represent a business without permission;
  • Interfere with the website, it’s operation or it’s security;
  • Introduce viruses, malicious code or other harmful material;
  • Use automated tools to scrape, extract, monitor or copy our content without written permission;
  • Copy our listings into another directory, database, platform or commercial service;
  • Use property or contact information from the website for unsolicited marketing; or
  • Use the website in a way that infringes another person’s intellectual property, privacy or other rights.

If we reasonably believe the website is being misused, we may block a submission, remove material or restrict access where needed to protect Exclusive Use, our property partners, website visitors or the website itself.

8. Information you share with us

When you submit an enquiry, you keep ownership of the information and material you provide.  You give us permission to use, store and share it only as reasonably needed to respond to your enquiry, introduce you to relevant property owners, provide our services, meet legal obligations and manage any concerns or disputes.

Please only share information that you are entitled to provide and that is reasonably needed for your enquiry.  Avoid including sensitive, confidential or unnecessary personal information in an enquiry form.

9. Our content and brand

In the evenThe words, images, property stories, design, branding and other content on the website belong to Exclusive Use, our property partners or is licensed to us.  You may not copy, reproduce, or distribute any content without prior written consent.

10. Privacy, cookies and communication

When you send an enquiry, we may share the information you provide with relevant property owners and service providers so they can respond and help with your request.

Our website may use cookies, analytics and similar technologies to understand how the website is used and improve the experience. 

When you send an enquiry, we may contact you about that enquiry and occasionally share updates, offers and inspiration from Exclusive Use. If you would prefer not to receive these communications, you can unsubscribe at any time. Any marketing messages we send will clearly identify us and include an unsubscribe option.

11. Loyalty Program

Membership in the Exclusive Use Loyalty Club is subject to separate program terms. Please contact Exclusive Use office for a copy.  Gift cards are issued as part of the Loyalty Program, and are issued for verified bookings only and cannot be exchanged for cash.

12. Links to other websites

You may find links to property websites, maps, social media pages and other third -party services on our website.  These links are provided to make your research easier.  Because third party websites are outside of our control, their own terms and privacy policies apply. We are not responsible for their content, availability, security or privacy practices.

13. Website availability

We work to keep the website useful, secure and available, but we cannot promise that iit will always operate without interruptions or errors.  From time to time, we may update, change, suspend or remove parts of the website.

Please use appropriate device security and take care when downloading material or following external links. If you notice a security issue or suspect misuse, let us know promptly.

14. Limitation of Liability

We provide the website and help facilitate introductions between website users and property owners. Each property owner remains responsible for their property, services, availability, pricing and booking arrangements. 

Exclusive Use is not responsible for any loss, damage, or inconvenience caused by third-party property owners or service providers.

15. Governing Law

These Terms & Conditions are governed by the laws of New South Wales, Australia.

16. Changes to Terms

We may update these Terms & Conditions from time to time.  Continued use of the site indicates acceptance of any changes.

17. A few final details

These terms cover use of our website.  They do not replace a property owner’s booking terms, the Loyalty Program Terms & Conditions, our Property Listing Terms, Services Agreement or any other written agreement for a specific service.
